ForeSite — Terms of Service

These Terms of Service ("Terms") govern your use of the ForeSite website, web application, and related services (the "Service") operated by ForeSite Quotes LLC ("ForeSite," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Early access. The Service is under active development. Features may be added, changed, or removed, and availability may occasionally be interrupted, without notice. We will not reduce what your paid plan includes mid-billing-cycle without notifying you, and you may cancel at any time. Feedback you choose to send us may be used to improve the Service without obligation or compensation.

1. What ForeSite Is — and Is Not

ForeSite generates AI-assisted estimates (job type, labor hours, material cost ranges, and pricing math) from photos and inputs you provide. Estimates are starting points, not professional appraisals, bids, or guarantees.

You must verify every estimate with your own on-site inspection, measurements, and professional judgment before quoting a customer.
You bear sole responsibility for the prices you quote, the contracts you enter, and the work you perform. ForeSite is a calculation and presentation tool; it is not a party to any agreement between you and your customer.
ForeSite does not provide contracting, engineering, architectural, legal, or licensing advice. You are responsible for complying with all licensing, permitting, and consumer-protection laws that apply to your trade in your jurisdiction.

2. AI-Generated "After" Images

"After" images are AI-generated illustrations of a projected result. They are conceptual visualizations only and are not promises, warranties, or guarantees of the appearance, quality, materials, or outcome of any completed work. You agree to present after-images to your customers as illustrations, not as commitments, and you are responsible for how you use them in your sales process.

2a. Scheduling and Contractor Terms

The Service lets contractors schedule appointments and attach their own terms (such as cancellation or refund policies) to a job. Those terms are set by the contractor and are an agreement between the contractor and their customer. ForeSite Quotes LLC displays them and records when a customer acknowledges them, but is not a party to that agreement and does not guarantee, enforce, or provide legal review of any contractor's terms.
Customer requests to reschedule or cancel are requests only; the appointment changes only when the contractor approves it. ForeSite is not responsible for missed, cancelled, or disputed appointments, or for any deposits, costs, or refunds between contractor and customer.

3. Accounts and Free Trial

You must be 18 years of age or older to create an account or use the Service. The Service is offered for business use and is not directed at children.
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
Phone verification and SMS. We verify accounts by sending a one-time code by text message to the number you provide. By creating an account you consent to receive that code and, if you enable two-factor login, subsequent login codes. These are transactional messages only — we do not send marketing texts. Message and data rates may apply. You may reply STOP to opt out, though doing so will prevent phone verification and two-factor login from working.
One account per person or business. The free trial is limited to three jobs per verified phone number. Circumventing trial limits (multiple accounts, recycled numbers, etc.) is grounds for suspension.
You must be at least 18 and able to form a binding contract to use the Service.

4. Subscriptions, Billing, and Refunds

Paid plans bill monthly in advance through our payment processor (Stripe). Plan limits (such as after-image generations per month) reset each billing cycle and unused allocations do not roll over.
You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
First-invoice guarantee: if you are not satisfied, you may request a full refund of your first subscription payment within seven (7) days of that first charge by emailing Support@foresitequotes.com. After that window, and for all renewal payments, payments are non-refundable except where required by law. If you believe you were billed in error, contact us within 30 days and we will review in good faith.
Invoicing. ForeSite can generate invoice documents for you. ForeSite does not process payments, does not collect money on your behalf, and is not a party to any transaction between you and your customer. Your customer pays you directly, by whatever method you arrange with them. You are solely responsible for the accuracy of your invoices, for any sales or use tax you charge, and for complying with contractor licensing, lien, and consumer-protection laws in your jurisdiction.
Image top-up packs are one-time purchases of additional after-image credits, and may include additional promotional credits at no charge. Top-up credits do not expire, are consumed after your plan's monthly allowance, and are non-refundable once any credit from the pack has been used.
We may change plan pricing or limits with at least 14 days' notice; changes apply from your next billing cycle.

5. Your Content and Photos

You retain ownership of photos and job information you upload ("Your Content"). You grant ForeSite a limited license to host, process, and display Your Content solely to operate the Service — including generating estimates and after-images and maintaining your job history.
You represent that you have the right to upload the photos you submit (e.g., permission to photograph the property) and that Your Content does not violate any law or third-party right.
Your marketing use — and your obligation. Estimates and AI-generated images produced from Your Content are yours to use in your own business marketing (social media, websites, advertising), on one condition: you must clearly identify AI-generated images as illustrations or visualizations, and must never present them as photographs of work you have actually completed. These images are computer-generated projections, not documentation of finished jobs. Presenting them as real completed work may constitute deceptive advertising under federal and state law, and you are solely responsible for how you use them.
You may delete jobs from your account, and you may request deletion of Your Content by contacting Support@foresitequotes.com. See our Privacy Policy for details on data handling.

6. Acceptable Use

You agree not to: misuse or attempt to disrupt the Service; access it by automated means without permission; reverse engineer it; upload unlawful, infringing, or malicious content; use after-images to deceive or defraud any person; or resell the Service without our written consent.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY OF ESTIMATES, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUT CAN BE WRONG. WE DO NOT WARRANT THAT ESTIMATES WILL BE PROFITABLE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR JOB.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORESITE QUOTES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR UNDERBID JOBS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE PAID NOTHING.

9. Indemnification

You will indemnify and hold harmless ForeSite Quotes LLC from claims arising out of your quotes, contracts, or work performed for your customers, your violation of these Terms, or your violation of any law or third-party right.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate accounts that violate these Terms, abuse trial limits, or create risk for the Service or other users. Upon termination we may delete Your Content after a reasonable retention period.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date; continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.

Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in Michigan or, at either party's election, by videoconference. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. All disputes must be brought in the parties' individual capacities, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Small claims carve-out. Either party may instead bring an individual claim in small claims court in Michigan if it qualifies. Either party may also seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Service.

You may opt out of this arbitration agreement by emailing Support@foresitequotes.com within 30 days of first accepting these Terms, with your name and account email.
